FORUM ON PROS AND CONS OF CERTIFICATION - Held on October 2, 2009

To Faculty Association Members:


The term certification is a standard term in the field of labour relations and labour law. When we say an employee group of any kind is unionized, we say they are certified under the Labour Relations Act. So when one talks about “certification” it basically means an employee group is unionizing in accord with the provisions of the Labour Relations Act.

The UVic Faculty Association is the officially recognized bargaining agent for employees at the University of Victoria, but is not certified under the Labour Relations Act as a union. There are both pros and cons to being unionized and there are always strong opinions both for and against unionization. This past year we have had several meetings and communication with different groups of members of the Faculty Association where sentiments were expressed that the Faculty Association should seek certification. Interestingly, most of these views have come from the “younger” (i.e. newer to UVic members). Many of these have come from other institutions that are unionized and they see some advantages to belonging to a union. Also, many of the younger members also see the inequities between UVic and other universities in certain areas such as salary, benefits, equity issues, childcare availability, etc. and think that we could fight better for these things as a union. Over half our members have been hired within the past 7 years, so this could be an issue of interest to a significant portion of our members.

Hence the forum.  We invited Liz Hodgson (UBC Faculty Association President) and Rick Kool (Royal Roads Faculty Association President) to participate. Doug Baer, our chief negotiator for the Framework Agreement last year, also participated. UBC is voluntary recognized. Royal Roads became a union as a result of a certification drive (members signed cards indicating their desire to form a union).  Each of them spoke about the experience at their own university, impact on their members, and what they saw as pros and cons to being a union.

Doug Baer was Faculty Association President at Western right before they unionized. He also has the experience of having moved from a university with a union to one without a union, so can compare how things worked under a union to how they work with our Framework Agreement.

Please note that we are NOT initiating a certification drive (i.e. Starting the process of attempting to form a union). This forum is strictly to get the dialogue going so Members can learn more about unions in an academic setting, how they work, what things might be better with a union, and what the down sides would be.

It is interesting to note that non-unionized faculty associations in Canadian universities are now in the minority.
79% of Associations across Canada had unionized by 2004. UVic, SFU AND UNBC are the only non-unionized post-secondary institutions in BC.  SFU has also had informational sessions about unionization this past year for their members.

The Agreement will be posted on the University and Association websites. The University will provide each newly appointed Member, and any Member who makes a request, with a copy of the current Agreement. The University and the Association will share equally the cost of producing these copies.
